Acceptance and scope

By accessing PocketShepherd, creating an account, starting a subscription, or using the service, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use PocketShepherd.

Service description

PocketShepherd provides scripture reading, saved study tools, quote and study features, premium entitlements, and AI-powered Refiners Fire mentoring. PocketShepherd is not an official product of any church or denomination, and no AI or product output should be treated as official church guidance, legal advice, medical advice, or professional counseling.

Eligibility and accounts

You must be at least 13 years old to use PocketShepherd. You are responsible for keeping your account credentials secure, for activity that occurs under your account, and for using accurate and current information. We may suspend or restrict access if we believe an account is being used unlawfully, fraudulently, or in violation of these terms.

Acceptable use

You may not use PocketShepherd to:

• Break the law or violate the rights of others.
• Abuse, scrape, reverse engineer, or interfere with the service or its infrastructure.
• Attempt to bypass usage limits, entitlement checks, or security controls.
• Submit content intended to exploit, threaten, harass, impersonate, defraud, or harm other people or the service.
• Upload or transmit malicious code, spam, or content that infringes intellectual property or privacy rights.

Your content

You keep ownership of content you create in PocketShepherd, such as notes, saved study items, messages, and other account-linked material. You give Winten AI Inc. a limited license to host, store, reproduce, process, and display that content only as needed to operate, secure, improve, and support PocketShepherd.

AI features and disclaimers

PocketShepherd includes AI-powered responses, summaries, study notes, mentoring flows, and voice features. AI output may be incomplete, incorrect, or not appropriate for your exact situation. You are responsible for how you use AI output and should apply your own judgment before relying on it. If you need legal, medical, mental health, or pastoral care, seek a qualified professional or trusted human leader.

Subscriptions, billing, and cancellation

Some digital features require a paid subscription. On iPhone, subscriptions are billed by Apple and renew automatically unless canceled through your Apple account settings at least 24 hours before the current billing period ends. On the web, subscriptions may be billed through Stripe where permitted, and those web subscriptions can be canceled from your PocketShepherd account settings to take effect at the end of the current paid period. Pricing, plan structure, feature availability, and entitlements may change over time.

Unless required by law or a billing provider's own policies, fees are non-refundable once charged. If you cancel, your paid access generally continues through the end of the current paid period.

Third-party services

PocketShepherd relies on third-party services such as Supabase, xAI, Stripe, Apple, Beehiiv, Google, Sentry, and Vercel. Your use of third-party services and sign-in or billing providers may also be governed by those parties' own terms and privacy policies. We are not responsible for third-party products or services we do not control.

Availability, updates, and termination

We may update, suspend, change, or discontinue any part of PocketShepherd at any time. We may also update these terms by posting revised terms to this page. Continued use after an update means the revised terms apply going forward. You may stop using PocketShepherd at any time, and we may suspend or terminate access for abuse, fraud, legal risk, or violations of these terms.

Intellectual property and feedback

PocketShepherd, its branding, interface design, software, and service materials are owned by Winten AI Inc. or its licensors and are protected by applicable intellectual property laws. If you send us ideas, suggestions, or feedback, you allow us to use them without restriction or compensation.

Disclaimers

PocketShepherd is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Winten AI Inc. disclaims warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy.

Limitation of liability

To the maximum extent permitted by law, Winten AI Inc. and its officers, directors, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity arising out of or related to PocketShepherd or these terms. Our total liability for any claim relating to PocketShepherd will not exceed the greater of the amount you paid us in the twelve months before the claim arose or fifty Canadian dollars.

Indemnity

You agree to defend, indemnify, and hold harmless Winten AI Inc. and its officers, directors, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your misuse of PocketShepherd, your content, or your violation of these terms or applicable law.

Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes arising from PocketShepherd or these terms will be resolved in the courts located in British Columbia, Canada.
